Xu Jiayin, the founder of the Evergrande Group, was sentenced to life imprisonment in the first-instance trial by the Shenzhen Intermediate People’s Court for crimes including financial fraud and illegally taking deposits from the public.
His political rights have been permanently taken away, and his personal property will also be confiscated.
The Evergrande Group and Evergrande Real Estate were fined a total of 15.82 billion yuan, and another 56 people involved were also sentenced.
This result shows that serious fraud and illegal fundraising will face severe punishment.
However, Xu Jiayin’s imprisonment cannot immediately solve Evergrande’s debt problems.
When Evergrande collapsed, it owed more than 300 billion US dollars. Many homebuyers, investors, suppliers, and bondholders are still waiting to get their money back.
The court ordered that illegal gains continue to be recovered and that victims’ losses be compensated first.
However, it is still unclear how much property Xu Jiayin has left that can be sold and how the recovered money will be distributed.
The liquidation of Evergrande and this criminal case are not the same legal procedure. Ordinary creditors must still seek repayment through other legal procedures.
This case also reminds people that excessive borrowing by real estate companies, improper use of presale home payments, and weak management can all create major risks.
